The Notary

In Mexico, some aspects of conveyancing (drawing up deeds “escritura” witnessing signatures) must be performed by a public notary (Notario). It is your lawyer and not the Notary who will check the statements, the Notary is a neutral party.

The job of the Notary is to witness the signing of the title deeds (escrituras) and to ensure that state taxes are paid on completion of a sale. Also it is the notary who will be in charge to notify the Land Registry and other authorities of your purchase. It’s normal for all parties to be present when the deed of sale is read, signed and witnessed by the notary, although either party can give someone a power of attorney (poder especial) to represent them and so, they will attend the signing of the Title Deed acting on their behalf.
