No restrictions apply to foreigners who wish to purchase real estate in France. However, in France, owners are not free to dispose of their estate as they wish. Certain family members, such as children have an absolute right to inherit certain parts of the owner’s assets. There are several solutions to postpone having the property passing to children and thereby overcome some of the inheritance problems. Purchasers must consider French succession law and its potential impact on their situation as early as possible, preferably prior to acquiring the property. The right purchase structure will depend on the purchasers’ specific circumstances and wishes. Therefore, expert legal advice is recommended in that respect.
